Manning changed data access protocol, U.S. argues at sentencing

FORT MEADE, Maryland (Reuters) - As a military judge considered sentencing for convicted U.S. soldier Bradley Manning, prosecutors argued that his leaks of classified information to the WikiLeaks website changed the way the military allowed intelligence analysts to access data.

Manning, 25, on Tuesday escaped a life sentence with no parole at his court-martial when Judge Colonel Denise Lind acquitted him of aiding the enemy, the most serious of 21 criminal counts against him. But he still faces the possibility of 136 years in prison on 19 other charges.

The slightly built Army private first class was working as a low-level intelligence analyst in Baghdad in 2010 when he was arrested and charged in the biggest leak of classified information in U.S. history - a trove of 700,000 battlefield videos, diplomatic cables and other files.

Following Tuesday's verdict, the court-martial at Fort Meade, Maryland, moved into the sentencing proceeding on Wednesday with arguments by military prosecutors and Manning's lawyers.

A prosecutor, Major Ashden Fein, said Manning's leaks "have impacted the entire system" for granting defense analysts access to classified information.

Manning's attorneys were expected argue that the Army private was not trying to jeopardize U.S. national security. He did not testify during his trial or during the first day of his sentencing hearing.

The first prosecution witness, retired Brigadier General Robert Carr, said that allowing young analysts such as Manning to have access to classified information was "hugely important" to the U.S. military.

In a court martial that stretched over two months, military prosecutors had argued that Manning became a "traitor" to his country when he handed over files to the anti-secrecy WikiLeaks website. The U.S. government charged that the breach put national security at risk. It also thrust WikiLeaks and its founder Julian Assange into the international spotlight.

Observers said the verdict could have "a chilling effect" on WikiLeaks by making potential sources of documents in the United States more wary about handing over secret information.

It could also encourage the United States to seek to prosecute Assange for his role in publishing the information.

Assange has been living in the Ecuadorean embassy in London for over a year to avoid extradition to Sweden, where two women have accused him of sexual assault. The activist says he fears Sweden might hand him over to U.S. authorities.

Army prosecutors contended during Manning's court-martial that U.S. security was harmed when WikiLeaks published videos of a 2007 attack by an American Apache helicopter gunship in Baghdad that killed a dozen people, including two Reuters news staff, diplomatic cables, and secret details on prisoners held at Guantanamo Bay.

Manning supporters who gathered at Fort Meade on Tuesday said they were relieved he had been acquitted of the most serious charge, but thought the sentence he could face was excessive.

"The remaining charges against him are still tantamount to life in prison," said Nathan Fuller. "That's still an outrage."

The verdict was praised by two U.S. Congressmen - Representatives Michael Rogers, a Republican who chairs the House intelligence committee and Democrat Dutch Ruppersberger, its ranking member.

"Justice has been served today. PFC Manning harmed our national security, violated the public's trust, and now stands convicted of multiple serious crimes," they said in a statement.

US Renewable Energy Tops Record in 2012

Renewable energy production hit an all-time high in the United States in 2012, according to a recent annual energy report.

A combination of government incentives and technological innovations has helped solar and wind power grow in the United States in recent years, the report suggests. From 2011 to 2012, solar energy production increased by 49 percent and wind energy increased by 16 percent, according to a Lawrence Livermore National Laboratory annual energy analysis published earlier this month.

"I attribute the steady growth to technological advancements as well as tax incentives and state mandates for renewable energy," said A.J. Simon, an energy analyst at LLNL, who wrote the report. "I would expect this to continue for a while."

Though the trend is notable, wind and solar energy combined still accounted for only about 2 percent of total U.S. electricity consumption in 2012. Denmark and Spain, in comparison, produced an average of about 30 percent of their energy from wind power last year. [Power of the Future: 10 Ways to Run the 21st Century]

Oil and natural gas accounted for the majority of energy consumption in the United States, and will likely continue to dominate given recent investments in hydraulic fracturing, or "fracking," Simon said. Fracking is the forceful injection of water, sand and chemicals deep into shale rock that releases previously trapped oil and gas deposits.?

By opening up reservoirs of cheap and accessible fossil fuels, fracking could slow efforts to expand renewable energy, though this remains uncertain, according to Simon.

'Potential game-changer'

Still, those involved in solar and wind energy production in the United States remain confident that these alternative options will continue to grow despite advancements in fracking.

"The turbines are capturing more energy and [the wind industry] is managing to keep costs low," said Jason Cotrell, the manager of wind turbine technology and innovation with the National Renewable Energy Laboratory.

Recent efforts to improve wind power have focused on making the turbines taller so that they reach stronger air currents higher above the ground. This would allow wind farms to expand to areas that have previously been unsuitable for turbines due to low ground-level wind speeds.

"That would be the potential game-changer, when every state in the U.S. could benefit from wind," Cotrell said.

Solar oversupply

Solar power has also benefitted from new innovations, but its recent success stems largely from a global oversupply of photovoltaic cells. The combined effects of the economic downturn in 2008 and overambitious renewable policies around the world resulted in an abundance of panels and a relatively small market, according to Tom Kimbis, vice president of Solar Energy Industries Association.

?At this point, Kimbis said, expanding the reach of solar energy depends more on the price of the panels than improving their efficiency.

"The efficiency of the panels is now good," Kimbis said. "The industry has been working to improve efficiency of solar cells for decades and it's easy to buy a solar module with a 20 percent or higher efficiency today. That's not really the issue right now. The issue that people care about is how much will it cost and will it work for them."

Costs depend largely on government tax incentives, which vary from state to state and from year to year. Cotrell and Kimbis both believe that current work in innovating solar and wind power will continue to reduce baseline prices and increase the prevalence of renewable energy in the United States.

Hendry served as energy minister from May 2010 to September 2012, and in May 2012 he signed the agreement about cooperating on energy issues with the Icelandic government.

Hendry?s new position raises questions as to whether a former minister should be able to profit from a job so closely related to an agreement made while in government, and whether a Conservative donor is getting a potential commercial advantage through his position, The Guardian writes.

Hendry responded that importing energy from Iceland is a long-term project that could prove beneficial for the U.K. in the future. ?If it can help deliver secure, affordable low-carbon electricity to U.K. consumers, it is something which is in the national interest,? he stated.

BMW's i3 concept has been kicking around for quite awhile, and so far we've seen the carbon fiber chassis, a you-wish prototype, many of the specs and even the price. All that remained was to see an actual car, and BMW has finally pulled the covers off of it today. The $41,350 (US pricing) vehicle will run for 80-100 miles on a charge while going from 0 to 60 MPH in seven seconds, thanks to the 22kWh battery, 170-horsepower electric motor and relatively slight 2,600 pound heft. If you opt to pay $45,200, you'll be able to nearly double the range, thanks to an optional 34-horsepower two-cylinder backup motor. That's pricier than the $39,145 Chevy Volt (which also has a backup gas motor), but BMW has equally high hopes for its premiere EV. It launched a dedicated sales channel for the i3 and future i-branded EVs, and even created a division dedicated to creating mobile apps for such cars. It'll arrive in Europe in November and we'll see it stateside during the second quarter of next year. Check the source or video after the break for more.

Was The Google Purchase of Motorola A Hardware Disaster With Overpriced Patents?

I have yet to release my review of Google's most recent quarter earnings results, but thus far I've seen nothing that would materially sway me from the conclusions drawn from the last set of forensic valuations released to subscribers (Google Q2 2013 Update: Valuing Possibly The Most Powerful Co. In The World?). One question that I am getting is "Did Google overpay for its Motorola acquisistion?"
Quick answer, I seriously do not think so. Please understand, the Wall Street fee/commission churning machine along with the tabloid financial media which has to churn content for advertising eyeballs has taught many (if not most) to view the investment world one fiscal quarter at a time. This is not a prudent, not sustainable model for building long term success. One of the most admirable traits of Google's management is their proclivity to think longer term, and to plan and invest accordingly.?
Below are excerpts from the big Google report that I put out two years ago. It outlines the acquisitions that Google had made to date. Among these acquisitions are investments that the financial media and the sell side analytical community swore were overpriced because they actually ate their own BS sandwiches, literally convincing themselves that one quarter at a time is the way to run a business poised to take over an industry.

Three examples come to mind also happen to be three of the largest acquisitions - YouTube, AdMob and Android. Were they worth it? What single company controls and/or leads in internet video content distribution, computing OS (not just mobile OS, but all computing OSs), and mobile advertising? All three of these acquisitions amounted to less than $5 billion and for that amount and additional investment, Google literally and absolutely dominates each and every one of those industries.?

Compare and contrast this to the Microsoft/Apple/Blackberry consortium that paid $4.5 billion for 6,000 telecomm related patents from Nortel. These companies are ALL currently lagging in growth and reach compared to Google, even if you just consider this one investment or if you look at their entire enterprise. The reason? Google's management is considerably more entrepenurial and are more adventurous at risk taking.

Google purchased Motorola for its cell industry patents for protection of its Android OS. Everything else that came with the deal was gravy. Factoring the handset/hardware biz, the set top box biz (recently sold) and the patents, the patents were purchased extremely cheap (17,000 of them) compared to what the RIMM/MSFT/Apple consortium paid for the Nortel patents ($4.5B for 6,000 patents). Even with the patent value significantly downgraded, it's still was a better deal than its competitors. Motorola can now be used to directly drive down the cost of hardware and hardware profit margins.

One must realize that Google Purchased 17,000 patents and the first cell phone manufactuer as well as one of the top tier manufacturers for nearly half of the their competition paid for just 6000 patents - RIMM/MSFT/Apple consortium paid $4.5 B for 6,000 Nortel patents. ? ?

Google will use the Motorola Mobility unit to further push down smartphone margins and costs instead of using it to make more profitable phones. Remember, Google is in the data business, not the smartphone business. The more people that have smartphones at any cost, the more money Google makes.? ? ?

One of the reasons why I think Google's missing of the mean analysts forcasts this quarter is not that big a deal is the extremely value rich product pipeline of product's nearing launch. As a beta tester and early explorer of Google Glass, I'm convinced that Microsoft, Blackberry and Apple have absolutely nothing to compare. Expect Google to expand its advantage over these companies materially over the next fiscal year.

Swimming: China's Sun adds world 400m gold to Olympic crown

BARCELONA: Olympic champion Sun Yang of China claimed men's 400m freestyle gold at swimming's world championships in Sunday's final to complete the set of major titles in the event.

Just as he did in the London 2012 final, the 21-year-old Chinese dominated early on in Barcelona to add the 400m world title to the 800m and 1500m freestyle gold medals he won two years ago in Shanghai.

Sun clocked 3min 41.59sec, finishing more than three seconds ahead of Japan's Kosuke Hagino, who swam 3:44.82, while Connor Jaeger of the USA finished in 3:44.85 to claim third.

"I give thanks to my coach and my parents," said an emotional Sun, who has moved his training base to Hong Kong in the last year.

"I have been training for this for the past 10 years and it has paid off."

Sun has had a turbulent 12 months since his London triumph after a row with his coach over the giant swimmer's love affair with an air stewardess.

Sun, the tall distance specialist from Zhejiang, rejected coach Zhu Zhigen's demand that he stop seeing his new girlfriend and concentrate on his swimming instead.

Despite a public show of reconciliation with Zhu, Sun has been training in Hong Kong under former Chinese head coach Zhang Yadong.

"Over the last year, I have experienced a lot of new things and I still managed to win the gold medal," said Sun.

"I have overcame many problems and proved myself tonight.

"I am very satisfied with my performance and I hope to have an even better performance in my other events."

At the halfway stage, Sun was on track to break Paul Biedermann's world record of 3:40.07, set four years ago at the Rome world championships, but the German ultimately holds on to the mark set using the now-banned high-tech suits.

After Sun finished second in the 400m freestyle at the Shanghai 2011 world championships, the 1500m freestyle world record-holder will be aiming to defend his 800m freestyle crown when the heats start on Tuesday.

Japanese teenager Hagino, who won Olympc 400m individual medley bronze in London last year, was not happy with his time, but delighted with his silver.

"It?s a really tough challenge for me, but I am trying to do my best and hopefully I will get a few more medals," said the 18-year-old Hagino, who won five titles at this year's Japanese national championships.

Bronze-winner Jaeger, 22, said he had endured a steep learning curve en route to claiming his first medal at a major event.

"I was in a pretty slow heat and I learned a lesson from that, you're never safe just because you win your heat," he said.

"There was a minute I didn't even think I'd get another swim, so I just went into the final with a lot of energy and enthusiasm and that turned into a great result."

(AP) ? Army Pfc. Bradley Manning's fate was in the hands of a military judge Friday after nearly two months of conflicting portrayals of the soldier: a traitor who gave WikiLeaks classified secrets for worldwide attention and a young, naive intelligence officer who wanted people to know about the atrocities of war.

Judge Col. Denise Lind said she will start deliberating Friday on the 21 charges Manning faces, but she did not say when she would rule, only that she will give the public a day's notice before her announcement. The most serious charge is aiding the enemy, which carries a potential life sentence in prison.

During closing arguments, defense attorney David Coombs said Manning was negligent in releasing classified material, but he did not know al-Qaida would see the material and did not have "evil intent," a key point prosecutors must prove to convict Manning of aiding the enemy.

Prosecutors contended Manning, 25, knew the material would be seen across the globe, even by Osama bin Laden, when he started the leaks in late 2009. Manning said the leaks didn't start until February the following year.

"Worldwide distribution, that was his goal," said the military's lead prosecutor, Maj. Ashden Fein. "Pfc. Manning knew the entire world included the enemy, from his training. He knew he was giving it to the enemy, specifically al-Qaida."

After Coombs finished his three-hour argument, there was a smattering of applause from Manning supporters, who were quickly hushed by the judge.

"All right, that's enough," Lind said. "This is a court of law. I would ask, please, that you keep your reactions muted."

Meanwhile, one of Manning's most visible supporters was banned from the trial Friday after the judge said someone posted threats online. Clark Stoeckley, a college art instructor from New Jersey, confirmed he was the one booted.

Stoeckley attended the court-martial often as a sketch artist, arriving each day in a white box truck with bold words painted on the sides: "WikiLeaks TOP SECRET Mobile Information Collection Unit."

A tweet Thursday night from an account Stoeckley used said: "I don't know how they sleep at night but I do know where." It was removed Friday and Stoeckley told The Associated Press on Twitter he couldn't comment.

Inside the courtroom, a few spectators smiled ? as did Manning ? when Coombs mocked a former Army supervisor who testified last week that Manning told her the American flag meant nothing to him and that she suspected before they deployed to Iraq that Manning was a spy. Coombs noted she had not written up a report on Manning's alleged disloyalty, though had written ones on him taking too many smoke breaks and drinking too much coffee.

Manning also faces federal espionage, theft and computer fraud charges. The Crescent, Okla., native has acknowledged giving WikiLeaks some 700,000 battlefield reports, diplomatic cables and videos. But he says he didn't believe the information would harm troops in Afghanistan and Iraq or threaten national security.

"The amount of the documents in this case, actually is the best evidence that he was discreet in what he chose because if he was indiscriminate, if he was systematically harvesting, we wouldn't be talking about a few hundred thousand documents ? we'd be talking about millions of documents," Coombs said.

Giving the material to WikiLeaks was no different than giving it to a newspaper, Coombs said.

"That's giving information to a legitimate news organization in order to hold the government accountable," Coombs said.

The government disagreed and said Manning would also be charged if he had leaked the classified material to the media.

Coombs also showed three snippets of video from a 2007 U.S. Apache helicopter attack Manning leaked, showing troops firing on a small crowd of men on a Baghdad sidewalk, killing several civilians, including a Reuters news photographer and his driver. Coombs said the loss of civilian lives shocked and horrified the young soldier.

"You have to look at that from the point of view of a guy who cared about human life," Coombs said.

Coombs has said Manning was troubled by what he saw in the war ? and at the same time was struggling as a gay man in the era of "don't ask don't tell." Those struggles made him want to do something to make a difference and he hoped revealing what was going on in Iraq and Afghanistan and U.S. diplomacy would inspire debate and reform in American foreign and military policy.

WikiLeaks founder Julian Assange said Friday in a telephone press conference that if the aiding the enemy charge is allowed to stand, it will be "the end of national security journalism in the United States."

He accused the Obama administration of a "war on whistleblowers" and a "war on journalism."

The verdict and any sentence will be reviewed, and could be reduced, by the commander of the Military District of Washington, currently Maj. Gen. Jeffery S. Buchanan.

Shadowrun Returns ships for Mac and Windows: The legendary RPG makes its triumphant comeback!

Harebrained Schemes on Thursday released Shadowrun Returns, a brand new tactical role playing game based on the enormously popular tabletop RPG that later became a popular computer and console game. As Secretary of State under President Ronald Reagan, George Shultz helped negotiate the most successful global environmental treaty to date: the Montreal Protocol, which phased out the use of chlorofluorocarbons and other ozone-depleting chemicals. Those chemicals also act as potent greenhouse gases, so the agreement also makes him the negotiator of one of the most effective global climate treaties ever, despite being part of an administration that famously removed solar technology from the White House roof.

Few modern Republican politicians favor such environmental effort, or even believe climate change is happening or that humanity could be primarily responsible for it. In addition, the Republican-controlled U.S. House of Representatives is currently suggesting that the federal budget almost eliminate support for the Advanced Research Projects Agency for Energy and other clean energy efforts from the Department of Energy. Still, Shultz continues to work for what he sees as improvements to U.S. national, economic and environmental security by addressing the growing threat of global warming through his role as chair of the energy policy task force of the Hoover Institution at Stanford University.

Scientific American sat down with the 92-year-old Schulz to discuss what can be done to combat climate change in the present political environment. The interview was held at his home in the hills above Stanford, which boast solar panels and his electric vehicle?a Nissan LEAF?in the garage.

Your long career in government was often focused on protecting the U.S. How will climate change affect national security?
I think in the energy area, we have to be constantly aware of three big objectives. Number one: we have to think of energy as a strategic commodity that is very important to our national security. Number two: we have to recognize that energy is the engine of the economy, so we want inexpensive, reliable, consistent energy. And number three: we have to recognize that energy produces pollutants as it burns, so it affects our environment. It affects the air we breathe; it affects the climate we create. So we have these three issues to keep in mind all the time, and you can't just do one or the other, but you've got to work on them all at the same time.

How is the military addressing the energy and climate challenge?
We see supply trucks blown up as they're going into Afghanistan, and, of course, that means first of all that people are losing their lives. Second of all, the net costs by the time you get the fuel there are astronomical. So you want to create more fuel where it isn't, so you don't have that transportation problem. The answer is to figure out how to create more energy where you use it.

Officials trying to control rig failure in Gulf of Mexico

NEW ORLEANS (AP) ? The owner of a drilling rig that's ablaze in the Gulf of Mexico said Wednesday they might drill a relief well, as part of a plan to control the natural gas well that blew wild.?

The company, Hercules Offshore, said the relief well is among the options being considered. It said it's also trying to find out why the well blew and then caught fire, but its first focus is cutting off the flow of natural gas.?

Hercules said all 44 workers on the rig were rescued without being hurt.

Snowden applies for political asylum in Russia, rants against Obama admin

President Barack Obama comments on former NSA worker Edward Snowden, who is reportedly still inside a Moscow airport without a valid passport. Obama made the remarks Monday in Tanzania.

Fugitive NSA leaker Edward Snowden has applied for political asylum in Russia, but President Vladimir Putin says he can stay only if he stops "damaging our American partners." And only hours later, Snowden released a statement railing against the U.S. government.

A consul at the Moscow airport where Snowden is reportedly holed up told Russia's official news agency, ITAR-TASS, that Snowden made the asylum application late Sunday. It was submitted by Sarah Harrison, a staffer with the anti-secrecy group WikiLeaks.

Hours later, Putin told reporters that Russian will not hand over Snowden to U.S. authorities, but said there would be strings attached if he wants to remain in Moscow.

?If he likes to stay here there is one condition: he should cease his work aimed at damaging our American partners. No matter how strange it will sound from me," Putin told reporters, adding that Snowden is not working for Russian intelligence.

He said he doubted Snowden would curtail his activities and suggested that the former National Security Agency contractor should figure out which country he wants to wind up in and "move there."

Snowden left the U.S. for Hong Kong before he leaked top-secret details of U.S. surveillance programs and was charged with espionage. With the help of WikiLeaks he traveled to Moscow eight days ago.

The U.S. does not have an extradition treaty with Russia, but President Barack Obama noted that Snowden traveled to Moscow without legal papers and referred to "high-level" discussions between the two countries about the case.

"We are hopeful that the Russian government makes decisions based on the normal? procedures regarding international travel and the normal interactions that law enforcement have," Obama said.

It was thought that Snowden would eventually head for Ecuador, but the president of the South American country said this week that no asylum request was sent and suggested Russia would make the call on where Snowden could leave and where he would go.

And in a statement released late Monday through WikiLeaks, Snowden claimed the White House is pressuring other countries to deny him asylum.

"The Obama administration has now adopted the strategy of using citizenship as a weapon," his statement said.

"This kind of deception from a world leader is not justice, and neither is the extralegal penalty of exile. These are the old, bad tools of political aggression. Their purpose is to frighten, not me, but those who would come after me," he added.

"Although I am convicted of nothing, it has unilaterally revoked my passport, leaving me a stateless person. Without any judicial order, the administration now seeks to stop me exercising a basic right. A right that belongs to everybody. The right to seek asylum."

While Snowden remains in legal limbo, new claims about U.S. surveillance based on his leaks continue to emerge.

Obama addressed reports that the NSA has bugged America?s European allies with something of a shrug, saying it should not be a surprise that intelligence agencies seek ?additional insight beyond what's available through open sources.?

"If that weren't the case, then there'd be no use for an intelligence service, " Obama told reporters while traveling in Africa.

?And I guarantee you that in European capitals there are people who are interested in, if not what I had for breakfast, at least what my talking points might be should I end up meeting with their leaders,? he added.

?That's how intelligence services operate.?

He said his team would look into the allegations and report back to European Union allies, who have expressed concern and, in some cases, outrage.

Secretary of State John Kerry, who is traveling in Brunei, echoed Obama's statement.

"I will say that every country in the world that is engaged in international affairs of national security undertakes lots of activities to protect its national security, and all kinds of information contributes to that, and all I know is that that is not unusual for lots of nations," he said.

"But beyond that, I'm not going to comment any further until I have all of the facts and find out precisely what the situation is."

Farrah Abraham will spend the next 10 days in a Florida rehab center.

"Teen Mom" star Farrah Abraham checked into a Florida rehab center late Sunday night, but not before video-blogging her car ride to the airport on her Keek site.

Abraham, who in the video said she was "sad" to leave her daughter, Sophia, will be spending the next nine days at The Lukens Institute, a luxury rehab facility in Palm Beach, Fla., recommended to Abraham's manager by Michael Lohan.

?(Farrah's manager) contacted me regarding Farrah and the treatment program The Lukens Institute offers," Lohan told TODAY.com. "It?s very individualized core issue and trauma therapy."

In a statement, Abraham said that completing an intensive outpatient program was required to satisfy the terms of her probation stemming from her March DWI arrest.

"I must complete in order to get off of probation, due to my DWI received in March earlier this year," Abraham said. "At this time in my life I need to stay focused on the positive to get through all of these negatives that this DWI has caused in my life. I?m 22 and I want to make better choices and insure I can recognize when I?m putting myself in a bad situation next time."

According to a document obtained by Radar Online, Phyllis Moczygemba, the executive director of the Austin Drug & Alcohol Abuse Program, recommended that Abraham complete a 60-hour intensive outpatient program. In the state-mandated evaluation, Moczygemba reported that Abraham had difficulty making eye contact, and that she was standoffish and "sarcastic when answering the questions asked of her."

Abraham's sister, Ashley Danielson, thinks entering the program is a positive start. "She?s going to rehab to avoid jail, but I?m happy she?s finally taking responsibility for her own actions,? Danielson told TODAY.com.

The reality personality won't exactly be roughing it during her rehab stay. "At The Lukens Institute, your room is like living in a suite at the Ritz Carlton," Lohan said.

This has been quite the year for Abraham. Following her March DWI arrest, she starred in a porn movie with adult film star James Deen, and has been making appearances at strip clubs and erotica conventions across the country to promote the film. Her stay in rehab will not conflict with any of her scheduled appearances.

?Our accelerated program is designed for motivated, high-functioning individuals with demanding careers and busy schedules who want private, individualized care, as well as a high degree of personal freedom," The Lukens Institute said in a statement.

Abraham won't have much time to reflect on her rehab experience. Three days after she is scheduled to check out of the facility, she will be making an appearance at the EXXXOTICA Chicago convention, followed by an appearance at Vivid's Gentlemen's Club in Charlotte, N.C.

But for now, she's happy to be getting help.
